Topology falsely reports intersection of lines in 3d

I created a feature class (polylines with z values), containing two lines which appear to intersect when viewed from above, but in fact have vertical separation between them.

If in ArcMap I create a topology specifying no intersection (with small tolerance both in xy and z) it falsely reports that the lines intersect.

If there a way to make this work correctly?
